Terms and Conditions of the GK-Handmade Online Store
§1. General provisions
- The GK-Handmade online store, available at www.gk-handmade.com, is operated by Katarzyna Kowalczyk, a sole trader trading as: Katarzyna Kowalczyk – GK Handmade, registered with CEIDG (registering authority: the competent minister/CEIDG), NIP (Tax ID): 7292408035, REGON: 100270297, address: Antenowa 18, 93-304 Łódź, Poland (hereinafter: the “Seller”).

§2. Nature of the products
- The products offered in the store are handmade and made to order after the order has been placed and paid for.
- The products are standard in nature, but are usually not held in stock — each item is made individually after purchase.
- In some cases, a product may be available for immediate dispatch — this will be indicated by the stock status on the product page.
- The order processing time may vary depending on material availability and the number of orders. Details are provided on the product pages.
§3. Placing orders
- Orders can be placed via www.gk-handmade.com.
- Placing an order requires acceptance of these Terms and Conditions.
- After placing an order, the Customer receives an e-mail confirmation acknowledging receipt of the order.
- Placing an order by the Customer constitutes an offer to purchase. The sales contract is concluded when the Seller sends an e-mail confirming acceptance of the order for processing (confirmation of the contract).
- The Customer can review and correct the information entered in the order (in particular delivery and invoicing details) during the checkout process, before the order is finally submitted.
§4. Prices and payments
- All prices shown on the website are gross prices. The Seller benefits from VAT exemption (where applicable) — prices do not include VAT.
- Available payment methods:
- Bank transfer
- Online payment (PayU)
- The order is accepted for processing once payment has been credited.
- Payment must be made within 3 days of placing the order; otherwise, the order will be cancelled.
- The total price of the order (product price + delivery costs and any other applicable charges) is always shown to the Customer in the order summary before the order is submitted.
§5. Delivery
- Products are delivered via:
- Courier services,
- InPost parcel lockers,
- In-person collection (if available).
- Delivery costs are indicated during the checkout process.
- Delivery usually takes 1 to 5 working days from the date of dispatch (depending on the selected method). The overall fulfilment time is: the making/picking time stated on the product page + the delivery time.
§6. Order cancellation by the Seller
- If the Seller is unable to fulfil an order (e.g. due to lack of materials), the Seller has the right to cancel the order and refund the full amount paid to the Customer.
§7. Personal data protection
- The Customer’s personal data are processed in accordance with the Privacy Policy available on the store’s website.
- Data may be shared with entities providing services necessary for performance of the contract, in particular payment service providers and delivery companies.
- The Customer has rights under the GDPR, including the right to access their data, rectify it, erase it, restrict processing, data portability, object to processing, and lodge a complaint with a supervisory authority.
§8. Final provisions
- Matters not governed by these Terms and Conditions are governed by Polish law. Changes to these Terms and Conditions do not affect orders placed before the changes take effect.
- A consumer may use out-of-court procedures for handling complaints and pursuing claims. Information is available, among others, on the UOKiK website regarding amicable consumer dispute resolution.
Returns Policy
§1. A customer who is a consumer has the right to withdraw from the contract
- Pursuant to the Polish Act of 30 May 2014 on Consumer Rights, a customer who is a consumer has the right to withdraw from a distance contract without giving any reason within 14 days of receiving the goods.
- To exercise the right of withdrawal, the customer must inform us of their decision by means of a clear statement (e.g. an e-mail with the model withdrawal form).
- In the event of withdrawal, the customer has the right to handle the goods to the extent necessary to establish their nature, characteristics and functioning. The customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the goods’ nature, characteristics and functioning.
- The customer must send the goods back without undue delay and no later than 14 days from the day on which they informed us of the withdrawal.

91725 Ehingen Germany - The cost of returning the product is borne by the customer, unless the Seller has expressly stated otherwise.
- We will reimburse payments received from the customer without undue delay and in any event no later than 14 days from the day on which we receive the customer’s notice of withdrawal.
- We may withhold reimbursement until we have received the goods back or the customer has supplied evidence of having sent back the goods, whichever is earlier.
- We will carry out the reimbursement using the same means of payment as the customer used for the initial transaction, unless the customer has expressly agreed otherwise — in any event, the customer will not incur any fees as a result of the reimbursement.
§2. Exceptions to the right of withdrawal
Pursuant to Article 38 of the Polish Act on Consumer Rights, the right of withdrawal does not apply in the case of:
- Products made to the customer’s special order and tailored to their individual needs (e.g. personalised handmade items).
- Products which, after delivery, are unsealed from their sealed packaging and are not suitable for return for health protection or hygiene reasons.
§3. Complaints
- For customers who are consumers (and, where applicable, sole traders treated as consumers under Polish law), complaints are handled under the rules on non-conformity of goods with the contract.
- If goods are non-conforming, the customer may request repair or replacement. In situations provided for by law, the customer may submit a statement requesting a price reduction or withdrawal from the contract.
- We are liable for non-conformity that becomes apparent within 2 years from the date of delivery of the goods.
- A complaint can be submitted by e-mail, describing the issue and providing details enabling us to identify the order (e.g. order number, payment confirmation).
- We will respond to the complaint within 14 calendar days of receiving it.
- If the complaint is accepted, we will bear the costs related to the complaint, including the costs of delivery/return to the extent required by law.

§5. Final provisions
Matters not regulated herein are governed by the Polish Act on Consumer Rights and the Polish Civil Code.
The rules set out in this Returns Policy apply in accordance with the currently applicable provisions of Polish law.
